1. About These Terms
This website, clickfencing.com.au (the "Site"), is operated by Click Fencing ("Click Fencing", "we", "us", "our"), a Western Australian pool fencing supplier. By visiting the Site, using our online tools, or purchasing from us, you agree to be bound by these Terms of Service ("Terms"), including any additional terms and policies referenced here (our Shipping Policy, Refund Policy and Privacy Policy). If you do not agree with these Terms, please do not use the Site.
We may update these Terms from time to time by posting the updated version on this page. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
2. Use of the Site
You may use the Site only for lawful purposes and in accordance with these Terms. You must not use the Site in any way that breaches any applicable law, infringes anyone's rights, or interferes with the operation or security of the Site. You must not transmit any worms, viruses or code of a destructive nature.
3. Intellectual Property & Site Software
All content on the Site — including text, graphics, logos, images, page designs, product data and pricing structures — and all software that powers the Site is owned by or licensed to Click Fencing and is protected by Australian and international intellectual property laws, including the Copyright Act 1968 (Cth).
This ownership expressly includes our interactive fence calculators and design tools (including the Frameless Glass, Blade, Flat Top and PerfMesh calculators), together with their underlying source code, algorithms, calculation and layout logic, panel-optimisation methods, user interfaces, graphics, fence preview renderings and output formats. These tools represent substantial original development by Click Fencing and are commercially valuable proprietary software.
We grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the Site and its calculators for the sole purpose of designing your own fence layout, obtaining quotes and purchasing products from us for your own project. You must not, without our prior written consent:
- copy, reproduce, republish, upload, post, distribute or publicly display any part of the Site or its calculators;
- decompile, disassemble, reverse-engineer or otherwise attempt to derive the source code, algorithms or calculation logic of any Site software;
- create derivative works from, or adapt, any part of the Site or its calculators, or use them (or their outputs) to develop, train or improve any competing product, tool or service;
- access the Site using any robot, spider, scraper or other automated means, or harvest or extract data, pricing or content from the Site;
- frame, mirror or embed any part of the Site on any other website or application; or
- remove or alter any copyright, trademark or other proprietary notices.
Quotes, cut lists and layouts generated by our calculators are provided for your own project use only. Any unauthorised use of the Site or its software may result in termination of your licence to use the Site and may expose you to civil and/or criminal liability. All rights not expressly granted are reserved.
4. Fence Calculators, Quotes & Measurements
Our calculators generate itemised product lists, layouts and pricing based on the measurements and options you enter. While we work hard to make them accurate, calculator outputs are quotes/estimates prepared from your inputs — they are not a survey of your site. You are responsible for the accuracy of all measurements, site conditions and selections you provide. We recommend double-checking all measurements before ordering. Quoted prices are valid at the time of generation and may change with product pricing updates.
5. Products, Pricing & GST
All prices are in Australian dollars (AUD) and, unless stated otherwise, include GST. Delivery charges are additional and shown before checkout. We take care to ensure product details and prices are accurate, but errors can occur; we reserve the right to correct errors, and to cancel and refund any order affected by a material pricing or description error. Products are subject to availability, and colours shown on screen may vary slightly from the finished product. We may modify or discontinue products, or update pricing, at any time without notice.
6. Orders & Payment
Your order is an offer to purchase; a contract is formed when we accept your order and payment is processed. We may refuse or cancel any order (for example, where a product is unavailable or an error has occurred) — in that case we will refund any amount paid for the cancelled order. You agree to provide current, complete and accurate purchase and account information, including a valid delivery address and contact details.
7. Delivery
Delivery is governed by our Shipping Policy. Risk in the goods passes to you on delivery. Please inspect all goods on delivery — glass products in particular — and notify us of any transit damage as set out in our Refund Policy.
8. Returns & Refunds
Returns and refunds are governed by our Refund Policy. Note that custom-made and cut-to-size items cannot be returned for change of mind. Nothing in these Terms excludes your rights under the Australian Consumer Law.
9. Pool Safety Compliance
Our pool fencing products are designed and, where stated, independently tested for compliance with applicable Australian Standards (including AS 1926.1). However, pool barrier requirements vary between states, councils and individual sites, and overall compliance depends on the final installed configuration — including ground surfaces, gaps, gate operation, non-climbable zones and boundary conditions. It is the property owner's responsibility to ensure the installed fence complies with all laws and regulations applicable to their site, and to obtain any required approvals and inspections. Information on the Site, including our Pool Safety Compliance Guide, is general guidance only and is not a substitute for advice from your local authority or a licensed pool barrier inspector.
10. DIY Installation
Where you choose to install products yourself, you are responsible for safe handling, correct installation in accordance with any instructions provided, use of appropriate tools and equipment, and compliance with all applicable standards and regulations. Glass panels and fencing materials are heavy and can cause injury if mishandled — if in doubt, engage a professional installer.
11. Warranties & Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. Any manufacturer's warranty (see our Warranty page) is in addition to, and does not limit, your rights under the Australian Consumer Law.
12. Limitation of Liability
To the maximum extent permitted by law, and subject always to the Australian Consumer Law: (a) the Site and its calculators are provided "as is" and "as available" without warranties of any kind as to uninterrupted or error-free operation; (b) we are not liable for any indirect or consequential loss, loss of profits, or loss arising from inaccurate measurements or information supplied by you, misuse of products, or installation not carried out in accordance with instructions and applicable standards; and (c) where liability cannot be excluded but can be limited, our liability is limited to the resupply of the relevant goods or services or the cost of resupply.
13. Third-Party Links & Tools
The Site may contain links to third-party websites or use third-party tools (such as payment processors). We are not responsible for the content or practices of third parties, and any use of third-party services is at your own risk and subject to their terms.
14. Privacy
Your personal information is handled in accordance with our Privacy Policy.
15. Severability & Waiver
If any provision of these Terms is found to be unlawful or unenforceable, that provision is severed to the extent necessary and the remaining provisions continue in full force. Our failure to enforce any provision is not a waiver of it.
16. Governing Law
These Terms are governed by the laws of Western Australia and the Commonwealth of Australia, and you submit to the non-exclusive jurisdiction of the courts of Western Australia.
